This suit in equity was brought by Clara Allen, a resident of the City of Washington, against Ernest P. Dovell and wife to annul a tax deed executed by the Treasurer of Prince Georges County conveying to Dovell a parcel of land situated between Glen Arden and Ardmore.
This case involves the liability vel non of the appellee for damage done the appellants by the backing of appellees truck into appellants property on Linden Avenue in the City of Baltimore. The case was tried before the court without a jury, and judgment was given for defendant. Plaintiffs appeal.
This appeal was taken by the Rev. William F. Hopkins, of Elkton, from the judgment of conviction entered upon the verdict of a jury in the Circuit Court for Cecil County for violation of the statute making it unlawful to erect or maintain any sign intended to aid in the solicitation or performance of marriages. Laws of 1943, ch. 532, Code Supp. 1947, art. 27, sec. 444A.
This is an appeal from a judgment for $14,000, entered by the court after the plaintiff filed a remittitur of $3,500, as directed by the court, from a jury verdict. The case arose out of an accident in Cumberland, in which a pedestrian was struck by a shifter" backing over a railroad grade crossing. The declaration alleged negligence on the part of the railroad company, in the operation of the shifter at an excessive rate of speed, lack of warning, failure to maintain a proper lookout, and failure to stop promptly after striking the plaintiff.
